• Account Termination: Guessko reserves the right to suspend or terminate accounts for violations of these Terms, including fraudulent activities or harassment.

• Prohibited Activities: You agree not to engage in any activities that violate these Terms or applicable laws. Prohibited activities include cheating, hacking, harassment of other users, and fraudulent behavior.
• Content Submission: You retain ownership of content you submit to the App. However, by submitting content, you grant Guessko a worldwide, non-exclusive, royalty-free license to use, modify, and display that content in connection with the App.

• Data Collection and Usage: At Guessko, we take your privacy seriously. Our Privacy Policy outlines the information we collect, how we use it, and the measures we take to protect your data. We collect personal information, such as your name, email address, and user-generated content, to provide you with a personalized experience within the App. This information may also be used for account verification, communication, and to enhance your overall user experience.
• Data Protection: We implement industry-standard security measures to safeguard your data from unauthorized access, disclosure, or alteration. Our data protection practices comply with applicable laws and regulations.

• User Content: User-generated content, including text, images, and videos, is owned by the respective users. However, you grant Guessko a license to use, modify, and display your user-generated content within the App.

• In-App Purchases: Some features of the App may involve in-app purchases. Payment terms, pricing, and refund policies will be detailed within the App.

• Right to Terminate: Guessko reserves the right to terminate or suspend user accounts for violations of these Terms, including but not limited to prohibited activities as outlined in Section 2. Such termination or suspension may occur without prior notice.
• Effect of Termination: Upon termination or suspension of your account, you will lose access to the App and its associated features. This includes access to any virtual items, tokens, or currency associated with your account. Guessko shall not be liable for any losses, including virtual items or currency, resulting from such termination or suspension.
• Appeals: In certain cases, you may have the opportunity to appeal a termination or suspension. Appeals will be considered on a case-by-case basis, and Guessko will review the circumstances leading to the action. However, the decision to reinstate an account is at the sole discretion of Guessko.
• Reasons for Termination: Termination or suspension of accounts may occur for various reasons, including but not limited to:
  • Violation of these Terms or applicable laws.
  • Engaging in prohibited activities such as cheating, hacking, harassment, or fraudulent behavior.
  • Repeated violations of community guidelines.
  • Suspicion of account compromise or unauthorized access.
  • Any actions that compromise the security or integrity of the App or its community.
• Appeal Process: If you wish to appeal a termination or suspension, please open a support ticket or contact us at support@guessko.com with the subject line 'Account Appeal'. Provide all relevant information, including your full name and the reason for the appeal. We will review your case and respond within a reasonable timeframe.
• No Liability: Guessko shall not be liable to you or any third party for the termination or suspension of your account, regardless of the reason. This includes any losses or damages resulting from the termination or suspension.
• Future Access: If your account is suspended, terminated, or if you voluntarily delete your account, you may not be able to access certain features of the App or create a new account without Guessko's express permission.

• No Warranties: Guessko provides the App "as is" without any warranties, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free from security vulnerabilities. Your use of the App is at your own risk.
• Use of Third-Party Services: Guessko may integrate or utilize third-party services, including but not limited to analytics providers. We do not control these third-party services, and their use is subject to their respective terms and privacy policies. Guessko shall not be responsible for any actions, omissions, or policies of third-party services.
• Limitation of Liability: To the maximum extent permitted by applicable law, Guessko and its affiliates, directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the App.
• Limitation of Damages: In no event shall the total liability of Guessko and its affiliates, directors, officers, employees, agents, or partners for all claims related to the App exceed the amount you paid, if any, for access to the App or any in-app purchases made within the App during the six months preceding the date of the claim.
• Exclusions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you. In such cases, Guessko's liability will be limited to the fullest extent permitted by applicable law.
• Legal Compliance: You agree to comply with all applicable laws and regulations while using the App. You are solely responsible for ensuring that your use of the App is in compliance with local, state, federal, or international laws.
• No Professional Advice: Any information or content provided by Guessko within the App is for informational purposes only and should not be considered professional advice. You should seek the advice of professionals in the relevant field for specific guidance or concerns.
• Survival: The disclaimers and limitations of liability in these Terms shall survive any termination or expiration of your use of the App.

• Applicable Law: These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict of law principles.
• Jurisdiction: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the federal and state courts located in the Northern District of California.
